HomeForeclosure
The Georgia foreclosure timeline, from missed payment to sale day
A Georgia foreclosure takes about five months at the soonest, counted from the first missed payment. Many take longer. The lender has to wait until you are more than 120 days behind. Then it must mail you notice at least 30 days before the sale and run an ad for four weeks. The house is sold at the county courthouse on the first Tuesday of a month.

Is your house on a sale list?
Power of sale: why a non-judicial foreclosure moves fast
Most Georgia home loans come with a security deed, and a security deed carries a power of sale. That lets the lender sell the house without filing a court case. Lawyers call this a non-judicial foreclosure. No judge sets the pace. A short list of fixed steps does, and each step has a date you can find.
Before the sale, the lender must also have the security deed on file with the clerk of superior court in your county. If the loan was sold, the paper that passed it to the new lender has to be on file too.
Days 1 to 45: the missed payment and the first contact
Most loans charge a late fee once a short grace time passes. Nothing else happens in the first weeks.
By day 36, most loan companies must try to reach you by phone or in person. By day 45, they must mail a letter that lists the kinds of help they offer and how to ask. Small lenders are outside this rule, and so are reverse mortgages and Farm Credit lenders. If you have a VA loan, VA puts a staff member on your file once you are 61 days behind.
Keep that day-45 letter. It has the phone number for the lender's help team. It also names the plans the lender offers. You will want both later.
Around day 60 to 90: the default letter
Fannie Mae and Freddie Mac use a standard Georgia security deed. It says the lender must send a default letter before it calls the whole loan due. That letter has to give you at least 30 days to catch up. It must also say you can go to court to argue you are not in default. Other loans may word this part in other ways, so check yours.
This stretch is the best time to send a complete help form. No sale is set yet, so the lender has room to look at it.
Day 120: the federal line
A federal rule bars the loan company from sending the first foreclosure notice until you are more than 120 days behind. It can't file one either. This rule covers small lenders too.
You may read online that the wait is now 150 days. It is not. As of September 2026, the rule on the books still says more than 120 days. You can find it at 12 CFR 1024.41(f).
The Notice of Sale Under Power: at least 30 days before the sale
Once past day 120, the lender can pick a sale date. Georgia law says it must send you notice at least 30 days before that date. It goes by certified or registered mail, or by overnight delivery. It goes to the house, or to another address you gave the lender in writing.
The notice is a copy of the sale ad, most often headed "Notice of Sale Under Power". It names the sale date and the law firm handling it. It must also name the person or company with full power to change your loan. That name comes with an address and a phone number.
The ad runs once a week for four weeks in the county's legal paper, the one it uses for public notices. Anyone can read it. That is why letters from buyers and lawyers start to pile up in the mailbox.
Sale day: the first Tuesday of the month
The sale is held at the county courthouse between 10 a.m. and 4 p.m. on the first Tuesday of the month. It is a live auction, and the highest bid wins. Often the lender is the one who bids, up to what it is owed.
If the first Tuesday is New Year's Day or the Fourth of July, the sale moves to the Wednesday after. The next first Tuesdays fall on these dates.

How long does foreclosure take in Georgia? A sample calendar
Say the payment due January 1, 2027 is missed, and none after it are paid. Here is how fast the steps could come, with June 1, 2027 about the soonest a sale could land.
Most take longer, though. A help form under review can add months, and so can a loan that moves to a new company or a sale the lender pushes to a later month.

What your sale date means for you right now
Take a sale set for December 1, 2026, and count back. For a help form to hold the sale, the lender has to have it complete by October 24. That is the last day more than 37 days out. Under the standard security deed, the right to catch up and keep the loan runs to five days before the sale. That day is Thanksgiving, November 26, so plan to pay by the 25th. A court order or a bankruptcy filing has to come before the gavel.
If you are past 120 days and no letter has come, you likely have at least a month. Use it to send the help form. The sale letter only has to come 30 days out, so the 37-day line can pass before it arrives.
Georgia Property Co. can find the sale ad in the county's legal paper and the security deed on file for your house, at no charge. Then you know which step you are on. If selling ends up being your choice, we can make an offer on the house.
After the gavel
The lender has 90 days after the sale to file the deed from the sale with the clerk. If it wants to sue you for any shortfall, it has 30 days to ask a judge to approve the sale. And the new owner has to go to court to make you leave. You get seven days to answer once the papers are served.
Questions people ask
How many days' notice do I get before a Georgia foreclosure sale?
At least 30 days by certified mail or overnight delivery, plus four weekly ads in the county's legal paper. The letter must give the sale date and who can change your loan.
Why is every Georgia foreclosure on a Tuesday?
State law sets public sales for the first Tuesday of the month at the courthouse, from 10 to 4. Sales under a security deed follow the same rule.
Does the lender have to go to court to foreclose in Georgia?
No. The security deed lets it sell without a judge. It goes to court after the sale only to chase a shortfall or to move you out.
Can the sale date change?
Yes. Lenders do move sales to a later first Tuesday. Ask the law firm named in the notice to confirm the date in writing, and watch the county paper.
If the 1st of the month is a Tuesday, is that the sale day?
Yes. December 1, 2026 is a sale day, and so is June 1, 2027.
Is the federal wait now 150 days?
No. As of September 2026 the rule still says the loan company can't start until you are more than 120 days behind.
